What happened
Real Decreto 806/2026, published on 6 October 2026, dissolved the Congreso de los Diputados and the Senado and called general elections for 29 November. The new chambers meet on 23 December. Under Article 207 of the Congress rules, all business still pending at dissolution lapses.
That includes the Proyecto de Ley Orgánica para el buen uso y la gobernanza de la inteligencia artificial, published on 12 June 2026 and still pending. Its Article 5.2(h) named AESIA, the Spanish AI supervision agency, as market surveillance authority for systems covered by the transparency duties in Article 50 of the AI Act. The explanatory memorandum placed the main transparency breaches among serious infringements, with fine ceilings set to the thresholds in Article 99 of the AI Act.
Why it matters
For a maker working in Spain, the labelling duty itself has not moved. Article 50 has applied directly across the EU since 2 August 2026, so a deepfake shown to the public still needs disclosure, in a form that does not hamper the enjoyment of an artistic work. What lapsed is the national layer: the named enforcer and the Spanish sanctions scale.
Still open
Whether the government formed after 29 November re-tables the bill is not known. Which authority currently handles Article 50 complaints in Spain could not be confirmed as of 27 October 2026.
